1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of summitcarehealth.com (the "Site") and the insurance brokerage services offered by Summit Care USA (the "Agency," "we," "us," or "our"). By using the Site, requesting a quote, communicating with our licensed agents, or otherwise engaging with our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
2. Description of Services
Summit Care USA is a licensed independent health insurance agency authorized to sell insurance products in all 50 United States. We act as a broker between consumers and insurance carriers. We are not an insurance carrier and do not underwrite, issue, or pay claims on any policy.
Our services include comparing available plans, providing quotes, explaining benefits and coverage limitations, assisting with applications, and providing ongoing service to enrolled clients. Our brokerage services are provided to consumers at no direct cost. Commissions are paid to the Agency by insurance carriers when a policy is issued. These commissions are built into the standard premium you would pay whether you purchased through us, another agency, or directly from the carrier — using Summit Care USA does not increase your premium.
3. No Coverage Guarantee
Requesting a quote, completing a form on the Site, or speaking with one of our agents does not enroll you in any insurance plan and does not bind any carrier to issue coverage. Coverage availability, eligibility, premiums, deductibles, networks, and benefit terms are determined by the carrier and are subject to underwriting, state regulation, plan-year changes, and applicable enrollment windows. All quotes are estimates until an application is submitted, accepted by the carrier, and an effective date is confirmed.
4. User Responsibilities
You agree to provide accurate, current, and complete information when requesting a quote or completing any form. Providing false or misleading information may result in declined applications, cancelled policies, denied claims, or other adverse consequences with the issuing carrier. You are responsible for maintaining the confidentiality of any login credentials, member portal access, or other account information provided to you by Summit Care USA or by a carrier.
You agree not to use the Site for any unlawful purpose, to attempt to interfere with the security of the Site, to upload viruses or malicious code, to scrape or harvest data, or to misrepresent your identity in communications with the Agency.
5. TCPA Communications Consent
When you submit a quote request form, check the consent box, and submit the form, you authorize Summit Care USA and its licensed agents to contact you at the phone number(s) and email address(es) provided — including by automatic telephone dialing systems, prerecorded or artificial voice messages, and SMS/text messages — regarding health, dental, vision, and hearing insurance options. Consent is not a condition of purchase. Standard message and data rates may apply. You may revoke this consent at any time by replying STOP to text messages, asking to be removed during a call, or emailing CustomerService@SummitCareUSA.com.
6. Disclaimers
Information provided through the Site and in conversations with our agents is general guidance about insurance products. It is not legal advice, tax advice, medical advice, or a substitute for the official plan documents issued by the carrier. Plan availability and terms vary by state and individual circumstances. Always consult the carrier's official policy documents for binding terms, exclusions, and limitations. THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Summit Care USA, its owners, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or any other intangible loss, arising out of or in connection with your use of the Site or our services. In no event shall the aggregate liability of Summit Care USA exceed the total commissions, if any, paid to Summit Care USA in connection with policies you have enrolled in through the Agency during the twelve (12) months preceding the event giving rise to the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Summit Care USA, its officers, employees, agents, contractors, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your violation of any law, your provision of false or misleading information, or your misuse of the Site or our services.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [State to be confirmed with insurance attorney prior to launch], without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in [County], [State], and you consent to the personal jurisdiction of such courts.
